These Terms and Conditions ("Terms") govern the use of the website https://jnv.ccl.iitgandhinagar.ac.in ("Website") and the purchase of goods and/or services offered through it, operated by the Indian Institute of Technology Gandhinagar, through its Centre for Creative Learning (CCL), having its office at Palaj, Gandhinagar – 382055, Gujarat ("IITGN", "We", "Us", or "First Party").

By accessing, browsing, or placing an order on the Website, the user ("User", "You", "Customer", or "Second Party") agrees to be bound by these Terms. If You do not agree, please refrain from using the Website.

1. Definitions

1. "Products" means any kits, educational materials, or goods listed for sale on the Website.
2. "Services" means any workshop, training, or service offered, booked, or delivered through the Website.
3. "Order" means a request placed by the User for purchase of Products and/or Services.
4. "Account" means the registered profile created by the User to access Website features.
5. "Content" means text, images, graphics, logos, video, and other material appearing on the Website.

2. Preamble

1. IITGN, through CCL, operates the Website to enable customers to browse, purchase, and avail Products and Services related to STEM education and learning materials.
2. These Terms, together with the Privacy Policy and Shipping Policy (collectively, the "Policies"), constitute the entire agreement between IITGN and the User in relation to use of the Website.
3. IITGN reserves the right to amend these Terms at any time, and continued use of the Website after such amendment constitutes acceptance of the revised Terms.

3. Eligibility

Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are minors, of unsound mind, or disqualified by law are not eligible to use the Website. If a minor uses the Website, it shall be deemed to be with the consent and supervision of a parent or legal guardian.

4. Account Registration

1. Users may be required to register an Account to place Orders. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your Account.
2. You agree to provide accurate, current, and complete information at the time of registration and to update it as necessary.
3. IITGN reserves the right to suspend or terminate any Account found to be fraudulent, inactive, or in breach of these Terms.

5. Products, Services and Pricing

1. All Products and Services are subject to availability. IITGN reserves the right to withdraw or modify any Product or Service listing without prior notice.
2. Prices displayed are inclusive/exclusive of applicable taxes as indicated at checkout and are subject to change without notice, provided that Orders already confirmed shall be honoured at the price applicable at the time of confirmation.
3. Product images and descriptions are for illustrative and informational purposes; actual Products, kits, or materials may vary slightly in content or appearance as part of ongoing curriculum development.
4. IITGN shall make reasonable efforts to ensure Product descriptions and pricing are accurate but does not warrant that such information is error-free.

6. Orders and Payment

1. Placing an Order constitutes an offer by the User to purchase, which is deemed accepted by IITGN upon dispatch confirmation or service confirmation, as applicable.
2. Payments may be made through the modes made available on the Website. All online payments are processed through third-party, RBI-authorised payment gateways, and IITGN does not store card or banking credentials.
3. Users are encouraged to carefully review Product/Service details, specifications, and applicability before placing an Order, as Orders are processed on a made-to-requirement / curated basis and confirmed Orders are treated as final commitments to purchase.

7. Delivery of Products / Rendering of Services

1. IITGN shall, on a best-effort basis, arrange for delivery of Products or provision of Services within the timelines indicated on the Website or Order confirmation.
2. Delivery timelines are indicative and subject to logistical, academic-calendar, and operational constraints, and time shall not be treated as the essence of the contract.
3. Risk in the Products shall pass to the User upon delivery at the address specified in the Order.

8. Exchange and Replacement Policy

1. Given the specialised and curated nature of the Products (educational kits and learning materials developed and assembled by CCL, IITGN), all confirmed sales are treated as final.
2. Where a Product is found to have a manufacturing defect or is damaged in transit, the User must report this to IITGN in writing within 7 days of delivery, along with supporting documentation (e.g., photographs, unboxing evidence).
3. Verified claims under clause (b) will be addressed through repair or replacement of the affected item(s), at IITGN's discretion, within a reasonable time. This clause does not apply to damage arising from misuse, improper storage, or normal wear and tear.
4. Requests for cancellation once an Order has been confirmed and processing has commenced may not be accommodated, given the customised procurement and assembly involved in fulfilling Orders.

9. Warranty

1. Products are warranted against manufacturing defects for 30 days from the date of delivery.
2. Any warranty claim must be reported within this period along with proof of purchase. IITGN will repair or replace defective items within a reasonable time of the claim being verified.
3. This warranty does not cover damage caused by misuse, unauthorised modification, or normal wear and tear.

10. User Obligations

The User agrees not to:

1. Use the Website for any unlawful purpose or in violation of these Terms;
2. Upload or transmit any content that is defamatory, obscene, infringing, or otherwise objectionable;
3. Attempt to gain unauthorised access to the Website, its servers, or any connected network;
4. Use any automated means (bots, scrapers) to access or extract data from the Website without prior written consent.

11. Intellectual Property Rights

1. All Intellectual Property Rights (IPRs) in the Website and in the Products, including design, content, curriculum, trademarks, logos, and Content, are owned by IITGN.
2. No right, title, or interest in any such IPR is transferred to the User by virtue of using the Website or purchasing Products/Services.
3. Users may not reproduce, distribute, modify, or create derivative works from any Website Content or Product materials without prior written permission of IITGN.

12. Hyperlinking Policy

1. The Website may contain links to third-party websites for the User's convenience. IITGN does not control and is not responsible for the content, accuracy, or practices of such third-party sites.
2. Other websites wishing to link to this Website must seek prior written permission, and such linking must not misrepresent IITGN's relationship with the linking site or be used in a manner that is disparaging or misleading.

13. Disclaimer of Warranties and Limitation of Liability

1. The Website and its Content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, except as expressly stated herein.
2. To the maximum extent permitted by law, IITGN shall not be liable for any indirect, incidental, or consequential damages arising from use of the Website or purchase of Products/Services.
3. IITGN's aggregate liability in relation to any Order shall not exceed the value of that Order.

14. Force Majeure

Neither party shall be held responsible for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including acts of God, war, flood, earthquake, strikes, lockouts, pandemic, epidemic, riots, civil commotion, or government action. The affected party shall notify the other in writing of such event and its expected duration. If such circumstances continue beyond a reasonable period, either party may treat the affected Order as cancelled, subject to Clause 8.

15. Privacy

Use of the Website is also governed by IITGN's Privacy Policy, which sets out how User data is collected, used, and protected in accordance with the Information Technology Act, 2000 and applicable rules made thereunder, and is incorporated herein by reference.

16. Non-Exclusivity and Amendment

1. Nothing in these Terms restricts IITGN from offering similar Products or Services through other channels, schools, boards, or organisations.
2. IITGN reserves the right to modify, suspend, or discontinue any part of the Website or these Terms at its sole discretion, with changes taking effect upon posting on the Website.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Clause 18 (Dispute Resolution), the courts at Gandhinagar, Gujarat shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

18. Dispute Resolution

1. In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiation.
2. Any unsettled dispute shall be brought to the notice of the Dean, Research and Development, IIT Gandhinagar, for resolution.
3. Any dispute that cannot be settled through the above process shall be justiciable exclusively in the courts within the jurisdiction of Gandhinagar, Gujarat.

19. Language

These Terms have been drafted in the English language, which shall be the binding and controlling language for all matters relating to their meaning and interpretation.

20. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
